Information about the agreement & legal terms

• "Additional Charges" means charges applicable to the provision of the Equipment which are charged in addition to the Charges including those additional costs and expenses referred to in these Terms.
• "Charges" means the charges set out in the Contract.
• "Contract" means the contract between Tom’s Trailer and Tool Hire and the Hirer.
• "Deposit" means a refundable Charge taken at the beginning of hire and refunded once Equipment is returned as hired out.
• "Equipment" means the items of Equipment to be hired by the Hirer as listed in the Order, all related accessories, manuals and instructions provided for the Equipment.
• "Hire Period" means the period of hire of the Equipment as set out in the Contract, unless the Contract is terminated earlier in accordance with these Terms or extended by agreement between Tom's Trailer and Tool hire and the Hirer.
• "Hirer" means the Consumer or Trader set out as such in the Contract.
• "Order" means individual orders for the hire of Equipment placed by the Hirer from time to time.
• "Replacement Cost" means the cost of replacing with new any item of Equipment or part of it including but not limited to the cost of the item or part of it, any unpaid Charges that would otherwise have been paid by the Hirer were it not for such replacement.
• "Site" means any premises or location at which the Equipment is to be delivered to or collected from or is otherwise located.
• "Terms" means these terms and conditions.

1 Contract and Orders

1.0 Each Order placed by the Hirer will be an offer by the Hirer to hire the Equipment on Tom's Trailer and Tool Hire terms and conditions. The Hirer will ensure that each Order is accurate and complete and that the Equipment is suitable for the Hirer's requirements.

1.1 A Contract will be formed between Tom's Trailer and Tool hire and the Hirer for the provision of the Equipment set out in the Order, when Tom's Trailer and Tool hire issues a written acceptance of the Order to the Hirer.

1.2 The Contract shall commence on the Commencement Date and shall continue for the Hire Period unless terminated earlier in accordance with these Terms.

1.3 The Charges for the Equipment will be payable by the Hirer to Tom's Trailer and Tool Hire in accordance with the payment terms set out in these Terms. In addition, Tom's Trailer and Tool Hire may invoice the Hirer for any Additional Charges which may be levied against Tom's Trailer and Tool Hire in relation to the Contract of Equipment.

2 The Equipment

2.0 The Hirer acknowledges that the Equipment remains at all times the property of Tom's Trailer and Tool Hire. The Hirer has no right, title or interest in the Equipment except that it is hired to the Hirer in accordance with the Terms of the Contract

2.1 The Hirer shall immediately notify Tom's Trailer and Tool Hire of any loss, accident, damage or defect in the Equipment or to the Equipment.

2.2 Tom's Trailer and Tool hire may access a Site to inspect and repair the Equipment.

2.3 The Hirer will replace any fuel in the Equipment. Where the Equipment is supplied with fuel, the Hirer shall return the Equipment with the same or a greater amount of fuel. Tom's Trailer and Tool Hire shall be entitled to charge the Hirer for any re-fuelling costs if the Hirer fails to comply.

2.4 The Hirer shall keep the Equipment in good repair and shall notify Tom's Trailer and Tool Hire immediately if any repair is necessary.

2.5 The Hirer is responsible for the security of the Equipment whilst in their possession.

2.6 The Hirer will take all appropriate measures to secure the Equipment at the Site including when not in use. This also includes storing equipment in a vehicle owned or hired by the hirer.

2.7 All costs and expenses in respect of damage to the Equipment occurring during the Hire Period is at the Hirer's risk. Cleaning Equipment following collection of the Equipment in each case to return the Equipment to a condition fit for rehire.

2.8 Risk will always remain with the Hirer until loading onto the collection vehicle is complete.

2.9 The Hirer shall grant or procure access to the Site to allow collection and delivery of Equipment.

3 Charges and Payment

3.0 A Deposit is required to hire the Equipment this must be paid before the hire takes place and is refunded on return of the Equipment in order it was hired out.

3.1 The Deposit shall be a deposit against default by the Hirer of payment of any Charges or any Additional Charges or any loss of or damage caused to the Equipment.

3.2 Tom's Trailer and Tool hire may off-set the Deposit against owed by the Hirer to Tom's Trailer and Tool Hire. This could be part or full amount.

3.3 Unless Tom’s Trailer and Tool Hire is entitled to make a deduction from the Deposit the full amount of the Deposit will be returned to the Hirer at the end of the Hire Period.

3.4 The Hirer must pay the Charges at the agreed time in the Contract, Tom's Trailer and Tool hire can charge interest if the Hirer pays late.

Information about the agreement & legal terms

• Hirers will hire equipment at their own risk.
• Equipment must be used correctly as per users manual or instructions given in verbal on collection or delivery.
• If a breakdown occurs on your job to our Equipment Tom's Trailer and Tool Hire will attend at a convenient time for the business.
• Safety Equipment (PPE) must be worn whilst operating equipment held.
• If a theft occurs while the Equipment is in the Hirer's possession, Tom's Trailer and Tool Hire will request a crime reference number and reserve the right to hold your deposit until investigations have taken place.
• All Damages will be taken from the Hirer's deposit held against Equipment on hire.
• No allowances can be made for bad weather conditions.
• Fuel must be replenished as supplied, the Hirer supplies their own running fuel unless agreed.
• Punctures are the Hirer's responsibility or chargeable.
• Equipment must be returned clean or face a £35 minimum cleaning fee.
• Excavator tracks that have been dislodged on your job will be charged at £45 per hour plus travel / call out fee depending on location of site.
• Tom's Trailer and Tool Hire does not accept liability for loss of earnings.
• On collections or deliveries we will ask to see two proof of identification i.e driver's license , passport or utility bill.
• Collection or delivery times are as agreed in verbal or in advance of the delivery. Updates can be given in advance.
• Holding fee could be asked to book a piece of equipment for a date, unfortunately this is non-refundable unless Toms Trailer and Tool Hire cancel your booking.
• We accept cash, bank transfer and card payments, we will require your details to refund your deposit.
• Collection and delivery charges are based on locations and priced independently.
• We only hire equipment per day, a standard working day is 8 hours the Equipment must be returned within the day or as agreed in verbal.
